1. Making a Booking
1.1 Anyone making a booking must be 18 years of age or older.
1.2 When Gill and Peter Stovold, (“the Owners”) issue confirmation to you
(“the Customer”), we enter into a contract which is subject to the Booking Terms and Conditions (“the Contract”).
1.3 The Contract will be governed by and subject to the laws of England and Wales and any dispute arising between the Owners and the Customer will be submitted to the exclusive jurisdiction of the Courts in England and Wales.
2.1 Payment by the Customer is made in accordance with the Booking Form and the total amount payable is noted thereon (“the Booking Price”).
2.2 A deposit of 25% of the Booking Price (“the Booking Deposit”) is payable by cheque or bank transfer at the time of booking accompanied by the Booking Form.
2.3 The balance of the Booking Price must be received by the Owners and funds cleared no later than 28 days before the Customer’s arrival date together with an additional cheque for £200 which will be used as a deposit against any damage (“the Damage Deposit”). This final payment must be made by cheque or bank transfer and sent in time for the funds to be cleared by the due date on the Contract.
2.4 If the Customer books less than 28 days before the due date on the Contract, payment of the Booking Price and the Damage Deposit must be sent immediately.
2.5 The Damage Deposit will be returned to the Customer within 14 days of departure provided that all the Booking Terms and Conditions have been complied with.
2.6 Cheques should be made payable to ‘The Coach-House’.
3. Cancellation by the Customer
3.1 If the Customer needs to cancel the booking, the Customer must contact the Owners as soon as possible in writing or by email.
3.2 The Booking Deposit is non-refundable.
3.3 The Owners will make every effort to re-let The Coach House and, if they are able to do so, the balance of the Booking Price will be returned to the Customer.
3.4 If the Owners are unable to re-let The Coach-House, the balance of the Booking Price remains payable.
3.5 The above terms are non-negotiable so the Owners recommend that the Customer invests in cancellation insurance.
4. Cancellation by the Owners
If the Owners have to cancel the booking in advance, the Customer will be refunded the full amount.
5. Damage to the Property
5.1 The Customer is responsible to the Owners for the actual cost of any breakages or damage to The Coach-House.
5.2 These costs may be deducted from the Damage Deposit but are not limited to that amount.
5.3 Breakages or damage are to be reported to the Owners at the earliest opportunity, but in any event prior to departure.
6. Accidents, Injury and Personal Property
6.1 The Owners shall have no liability to the Customer for the death or personal injury to the Customer or any member of the party for the duration of the Contract.
6.2 The Customer must take all necessary steps to safeguard personal property.
6.3 No liability to the Customer is accepted in respect of loss or damage of such property.
7. Care of The Coach-House
7.1 The Customer must take all reasonable and proper care of The Coach-House and its furniture, pictures, fittings and contents, both inside and out, for the duration of the Contract.
7.2 The Customer must leave the Coach-House in the same clean and tidy condition at the end of the Contract as at the start, and clear of rubbish.
For the duration of the Contract, the Customer or any member of the party must not do anything which may void the Owner’s insurance policies
9. Use of the Grounds at The Old Rectory
9.1 The Customer may enjoy the grounds of the Owners’ property (“The Old Rectory”), excepting the Owners’ private garden.
9.2 The following is strictly forbidden:
9.2.1 Picking flowers, fruit, vegetables and grapes;
9.2.2 Walking in the flowerbeds;
9.2.3 Swimming or wading in the pond; and
9.2.4 Disturbing the wildlife and ducks.
9.3 The Customer must ensure that they do not drop any litter anywhere in the grounds.
10. Smoking and General Nuisance
10.1 Smoking is not permitted in The Coach-House or anywhere in the grounds.
10.2 Barbeques are not permitted.
10.3 The Customer undertakes not to do or permit anything at The Coach-House or in the grounds which is illegal, may cause damage, or may become a nuisance, annoyance, inconvenience or disturbance to the Owners or any owner or occupier of neighbouring properties.
Pets are strictly forbidden.
12. Number of Persons in The Coach-House
12. 1 The number of people occupying The Coach-House must not exceed the maximum number stated on the Booking Form, or the maximum number permitted, namely four.
12.2 The Owners reserve the right to refuse entry to the entire party if this condition is not observed.
13. Owners’ Right of Entry
The Owners must be allowed access to The Coach-House at any reasonable time during the Customer’s stay for the purposes of:
13.1 Investigating a problem that has been notified to the Owners; and
13.2 Investigating when the Customer is believed to be misusing The Coach-House and / or in breach of the Booking Terms and Conditions.
14. Your Access
14.1 The Customer can arrive at The Coach-House after 3pm on the start date of the Contract.
14.2 The Customer must vacate The Coach-House by 10am on the final day of the Contract.
15.1 Should there by any cause for complaint during the Customer’s occupation of The Coach-House, it must be notified to the Owners promptly and, in the case of a serious problem, should be notified immediately and in writing.
15.2 If a complaint is made, the Owner reserves the immediate right to access to The Coach-House to investigate and rectify the problem.
16.1 The following events will trigger the Owners’ right to immediately terminate the Contract:
16.1.1 If the Customer or any member of the party behaves in a way in which the Owner deems it to be unreasonable or antisocial.
16.1.2 If the Customer or any member of the party is found to be smoking in The Coach-House or in the grounds.
16.1.3 If the Customer or any member of the party brings a pet into The Coach-House or in the grounds.
16.1.4 If at any time for the duration of the Contract, the number of guests exceeds the permitted number as stipulated in Clause 12 above.
16.1.5 If the Customer or any member of the party behaves in such a way so as to void the Insurance for The Coach-House (or other related policies) in contravention of Clause 8 above.
16.2 On termination, the Customer and all members of the party must immediately vacate The Coach-House, subject to the obligations in Clause 7.2 above, and the Contract will then be deemed to have come to an end.
17. Peaceful Enjoyment
Subject to the Customer’s observance of all the above Booking Terms and Conditions, the Owners will respectfully allow the Customer peaceful enjoyment of The Coach-House for the duration of the Contract.
18. Third Parties
A person who is not a party to the Contract shall not have any rights under or in connection with it.
